The controller responsible for personal data processed through the Modern Presence Lab store is Furkan Cicek, Entrepreneur individual, operating the public-facing brand Modern Presence Lab.

Depending on how a visitor uses the store, Modern Presence Lab may process:

• identity and contact details, including name, email, telephone number and billing address;
• business and project information submitted through forms, briefs, emails and uploaded files;
• order, service, invoice, payment-status and transaction-reference information;
• account and customer-service communications;
• technical information such as IP address, browser, device, session and security logs;
• cookie, consent and analytics information where the relevant tools are enabled; and
• information required to prevent fraud, maintain security and comply with legal obligations.

Complete payment-card credentials are handled by payment providers and are not made available to Modern Presence Lab in full.

Personal data may be used for the following purposes and legal bases:

• Contract performance: processing orders, collecting project requirements, providing services, delivering files, communicating about the project and handling support.
• Legal obligations: accounting, invoicing, tax, fraud prevention, responding to lawful requests and retaining required records.
• Legitimate interests: protecting the store, improving service quality, securing systems, preventing abuse, managing business operations and defending legal claims, balanced against the rights of individuals.
• Consent: optional marketing communications and non-essential cookies or analytics where consent is legally required.

Where data is required to form or perform a contract, failure to provide it may prevent Modern Presence Lab from accepting or completing the order.

Data is accessible only where reasonably necessary to Modern Presence Lab and service providers supporting store operation, including Shopify, payment processors, email and communication services, cloud storage, professional advisers, fraud-prevention providers, analytics providers where enabled and public authorities where disclosure is legally required.

The store is operated using Shopify. Shopify and its approved subprocessors may process information in countries outside the European Economic Area. Where required, transfers are supported by recognised safeguards such as adequacy decisions, binding corporate rules or standard contractual clauses.

Modern Presence Lab does not sell personal data to advertisers.

Data is retained only for as long as needed for its purpose or an applicable legal obligation:

• project and customer-service records: for the relationship and a reasonable period needed for follow-up, claims and evidence;
• commercial correspondence and contracts: generally up to five years where required for business records or legal claims;
• invoices and core accounting records: generally seven years under Dutch tax-administration rules, with longer periods where a specific legal rule requires it;
• prospect data used for marketing: generally no longer than three years from collection or the last meaningful contact, unless consent is renewed or an objection is recorded;
• cookie and consent records: for the period appropriate to the cookie or proof of the user’s preference; and
• security logs: for a limited period proportionate to security and fraud-prevention needs.

Data may be archived for a longer period where necessary to establish, exercise or defend legal claims or comply with a binding legal requirement.

Subject to the conditions of applicable law, an individual may request access, correction, deletion, restriction, portability or objection to processing. Consent may be withdrawn at any time without affecting processing already carried out lawfully.

Requests should be sent to support@modernpresencelab.com. Modern Presence Lab may request reasonable proof of identity where necessary to protect the data concerned.

An individual may also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP) or another competent supervisory authority.

Reasonable organisational and technical safeguards are used to protect personal data against unauthorised access, alteration, disclosure or loss. No online system can guarantee absolute security.

Essential cookies may be used to operate checkout, remember settings, prevent fraud and maintain store security. Non-essential analytics or advertising cookies should be activated only in accordance with the visitor’s consent choices where consent is required.
